Justice David Maraga missing in Zimbabwe-Kaweesa Keefa

A Zimbabwe Election Commission has declared the incumbent Zimbabwean President Emerson Mnangagwa of ZANU PF winner of presidential election 2018 with 50.8 per cent beating his main rival Nelson Chamisa who had 44.3 per cent votes.

Chamisa is disputing the results.

Under the laws of the country, Chamisa can go to court and present his case.

It would be up to court to determine or reject the claim and maintain that  Mnangwagwa won the election or nullify the results in which case call for fresh  presidential elections to be held as provided for in the constitution of Zimbabwe.

Section 93 of the Zimbabwe constitution provides that any aggrieved  candidate may challenge the election of a president or vice president by lodging a petition or application with the constitution court within 7 seven days  after the declaration of the results of the election.

Section 93 (3) thereof, states that the constitution court must hear the petition within fourteen days after the petition was lodged and the court’s decision is final.

The court may declares a winner or invalidate the election in which case a fresh election must be held within 6o days after the determination.

However in Africa, its only in Kenya where Justice Maraga, Justice Mwilu and Justice Leneola  had the guts to nullify the Kenya 2017 elections  and order for fresh elections.
